How to File a FIR in Police Station

How to FIle a FIR in Police Station

Registering an FIR (First Information Report) come under BNSS (Bharatiya Nyaya Sanhita, 2023), which has replaced the Indian Penal Code (IPC). The BNSS retains the basic procedure for FIR registration but with some modifications.

Steps to Register an FIR under BNSS:

1. Visit the Police Station

Go to the police station that has jurisdiction over the place where the crime occurred. You can also file an FIR online in some states.

2. Provide Details of the Incident

Give the following information:

Your name, address, and contact details

Date, time, and location of the crime

Details of the accused (if known)

A clear description of what happened

Any evidence (photos, videos, documents)

3. FIR Must Be Recorded in Writing

Under BNSS, just like the IPC, the police must write down your complaint and read it back to you for confirmation.

4. Right to Receive a Copy of FIR

As per Section 173 of BNSS, after the FIR is recorded, you must be given a free copy.

5. Zero FIR Option

If you are at a police station outside the jurisdiction of the crime scene, you can file a Zero FIR, which will be transferred to the relevant police station.

6. Online FIR Registration (Where Available)

Some states allow online FIR filing for non-cognizable offenses. Check your state’s police website.

7. If Police Refuse to File an FIR

Approach a higher police officer (Superintendent of Police or Commissioner).

File a complaint under Section 178 of BNSS, which mandates police action.

Approach a magistrate under Section 179 of BNSS, who can order police to register the FIR.
